The Judicial Action and the Moralities of Public Defense: The ‘Proceduralizing’ and the Relations with the ‘Judicial Family’

ABSTRACT

The Judicial Action and the Moralities of Public Defense: The ‘Proceduralizing’ and the Relations with the ‘Judicial Family’ aims to understand how the judicial actions of public defenders working in criminal courts are guided by the morality of these actors. It describes informative practices and discourses observed in the performance of public defenders in the instruction and trial hearings, as well as in the conduct of defensive activities. The investigation concludes that the criminal procedural defense activities are guided by the morality of the actors in relation to the criminal fact and the criminal subject, as well as a structuring element of the organizational logic of the defense technique, classified as proceduralization.
