Human Rights of Capital: Law Reflection and Command of the Labour Force

Abstract

The paper aims at to show an immanent analysis of human rights from the point of view of capital and labour contradiction. We offer both a discussion of historical struggle of labour against capital and of the International bill of human rights, the Declaration on fundamental principles and rights at work, besides an analyse of materialisation of such rights by Vale and Elektro. The research suggests that the human rights at work have as condition the reproduction of economic exploitation of labour and do not aim at, by no way, its abolition. The paper also analyses the potency of such rights to the tactics, which aim at the emancipatory process of working class.
