Established or outsider? A study on the presence of Niklas Luhmann’s work in Brazilian law

Abstract

The purpose of the present study is to reflect on the presence of Niklas Luhmann's work in Brazilian Law. The research was bibliographic and documentary. The paper investigates Luhmann's presence in theses and dissertations, comparing his presence with that of other established social theorists and jurists, it also shows a brief review of Luhmann's presence in judicial decisions and legal manuals. Subsequently, a brief review of Luhmann's main works is presented in order to reactivate the understanding of his most important concepts. The paper presents, then, some of the main agents responsible for the cycle of consecration of Luhmann in Brazil and a critical review of the appropriation of his work in the country.
