THEORETICAL TRENDS ON THE LEGAL EDUCATION FROM 2004 UNTIL 2014: A QUEST FOR THE CRITICAL THINKING

Abstract

This work presents a study of the legal education, as well as a comparative analysis between relevant Brazilian authors in this field of knowledge. The question that prompted this investigation was: based on state-of-the-art type of research, how to think through the comparative analysis of the theoretical trends of legal education in Brazil from 2004 to 2014? The method consisted on the analysis of 5,114 sources through which the research developed and highlighted five authors: Horácio Wanderlei Rodrigues, Luis Alberto Warat, José Eduardo Faria, Eduardo Carlos Bianca Bittar and Roberto Lyra Filho. These authors emphasized the lack of critical reasoning in undergraduate programs in Law. As a result, the quest for a critical reasoning based on education emerges as a central point of convergence amongst the enumerated authors, who evince the fragility of the critical reasoning aspect in the education of future Law professionals. As a consequence, there is the need to overcome this state through rigorous investigations remarking other realms of knowledge in the field of Law, such as Philosophy, Sociology, Psychology and History.
