This article deals with the connection between State and Health regarding to the difficulties of conception and concerning to the retaking of its trajectory, both in Europe and Brazil. It also provides elements to the reflection that Health is not only a social right but also a State's duty guaranteed by Federal Constitution. This paper also points out the challenges set to the United Health System.
