The quadrilemma of exclusion, inclusion, overexploration and protection of personal data of children and adolescents from the perspective of fraternity

Abstract

Digital exclusion affects many fields, such as the educational, social, and legal areas, and its effects, as this research supports, accomplish an upside-down agenda, of overexploitation of rights, rather than inclusion and protection. With the objective of examining the recognition and permanence of these corresponding rights, this study aims to reinforce inclusion, in relation to the protection of these rights, particularly that of the personal data of children and adolescents, in contrast to their exclusions and the overexploitation of rights. The deductive method is used through a review of national and foreign bibliographic references. It is concluded that fraternity is the most adequate tool for assuring the protection of rights and to not only address, but also solve the problem of these non-rights or overexploitation, having the child and adolescent as focus, to give them opportunity, voice, interpretation, language, and reparation of rights.
