Abstract
The article aims to perform critical reflections about the comparatist approach of Constitutional law regarding the indigenous law, taking into consideration the peculiarities of the Latin-American reality and seeking the locus of the rights of Indians between a General Constitutional Law and a Cultural Constitutional Law.
