CRITICAL ANALYSIS OF MISOGYNISTIC IDEOLOGICAL SOCIO-DISCURSIVE PRACTICES: THE INSTITUTIONALIZATION OF GENDER VIOLENCE AGAINST WOMEN IN THE JUDICIAL SPHERE

Abstract

The study aims to understand how the misogynist ideological socio-discursive practices, in factual aspects, of a 2019 conviction by the São Paulo State Court of Justice contribute to the institutionalization of gender violence against women in Brazil. Judiciary System. For this, we articulate epistemological-legal, empirical-social, and theoretical-linguistic aspects in which Critical Discourse Analysis emerges as a strategic theoretical-methodological resource of interdisciplinary knowledge in Fairclough (2016); Van Dijk (2015) and Thompson (2011), which, aimed at formulating the categories of analysis, made it possible to detect the patriarchal marks of a misogynistic ideological nature present in the discursive construction of the Judiciary. Also, such discourses produced in the context of manipulation and abuse of power legitimately affect the spread of gender violence against women.
