The new rights and guarantees

Abstract

The phenomenon of new constitutionalism has produced enormous impacts in the context of Public Law throughout the entire globalized world. One of the major changes that occurred in the Public Law after the new constitutionalism is the incorporation of new rights and guarantees to the contemporary constitutions. The purpose of this article is to analyze the construction and the legal content of some of these new rights and guarantees, such as environmental rights, the rights of consumers and users, collective rights, the right of assembly, the right to health, among others.
