Carl Schmitt’s teorethical contribution to Nazy law

Abstract

This article analyzes how Carl Schmitt’s theoretical work, especially the “concrete order thought”, influenced by institutionalism, contributed to the Nazi transformations of German law. Through a bibliographic analysis, I demonstrate that the combination of institutionalism and decisionism in Schmitt’s work supported the Nazi legal order and gave a prominent role to anti-formalist and anti-positivist methods of legal interpretation as instruments for the nazification of law.
