Chronicles of announced evictions: analysis of decisions about urban land conflicts

Abstract

The article proposes the reflection on the participation of the Judiciary in the (re) production of urban socio-spatial segregation in Brazil. For that, an empirical research was conducted with the collection and analysis of decisions on urban land conflicts of a collective nature. The collected sources comprise decisions rendered in Courts of Justice of the five Brazilian regions in the period between 2014-2015. The decisions pronounced by the Superior Court of Justice and the Federal Supreme Court between the years of 2002 and 2015 were also included. Of the analyzed articles, 311 decisions were selected, systematizing the content underlying the respective grounds that authorize the forced removals. The results obtained in the qualitative analysis are presented in the present work and allow to glimpse the understanding of the Brazilian Judiciary about the relations between rights, spatiality and subjectivities in the cities.
