Conflicts, Violence and the Xukuru Case at the CIDH

Abstract

Brazil's Xukuru case before the Inter-American Court is considered paradigmatic and inspiring for the exercise of ensuring fundamental rights in Brazil. However, the institutionalised violence and criminalisation experienced by this people over the past decades seem to have been overlooked in the Court's decision, being subsumed by technical issues. Faced with this problem, this study aims to describe the complexity of the subject, making use of anthropological arguments based on bibliographic research, given the vast scientific production in the area of Anthropology and Sociology about the people, and on documentary research in order to add “flesh” and “blood” into the cold letter of the law.
