Sovereign debt restructurings: the debate over its regulation in terms of a global governance dispute

Abstract

This article, using a comparative analysis, shows that the IMF proposal (2014) for ordering restructurings reinforces, to a greater extent than the Argentina initiative discussed at the UN (2015), the status quo and, from there, the dominant position in the global governance of the agents who promoted it. It is argued that this consideration is relevant at the time of understanding why these agents opposed to the drafting of a restructuring legal mechanism at the UN.
