Elements for the criticism of the law in the light of Theodor W. Adorno’s Negative Dialectic

Abstract

The article seeks to extract elements for the critique of the law in the light of Theodor W. Adorno's Negative Dialectic. The theoretical contribution made by the author allowed dialectical thinking to adjust to the philosophical questions posed by the 20th century, such as the denunciation of the great systems and metanarratives. The criticism of the identity paradigm, whose origin goes back to the economic circuits of exchange of equivalents, allows a relatively original approach with regard to the figure of the subject of right. Thus, based on the models presented by the author in the third part of his work, we seek to develop certain epistemological reflections in the context of some categories specific to his dialectic, with a view to a more adequate understanding of the normative moment of the legal phenomenon. The results point to an expansion of the critical spaces of the legal phenomenon within the dialectical tradition.
