PROHIBITION OF DISCRIMINATION ON GROUNDS OF RACE AND ETHNIC ORIGIN IN THE EUROPEAN CONTEXT, IN PARTICULAR IN THE EMPLOYMENT RELATIONSHIP

Abstract

This article intends to address one of the discrimination factors prohibited in several European normative instruments: race and ethnic origin. It starts with a more general analysis for the respective application of the prohibition of discrimination on grounds of race and ethnic origin to the employment relationship. The study is contextualized in the light of a set of events that have motivated the public debate on the subject. A reflection on the concept of “race and ethnic origin” is carried out, the international and European sources are analyzed, as well as the jurisprudence of the ECJ and the ECHR. The intrinsic relationship between the prohibition of discrimination and the dignity of the human person is sought, which requires the proclamation of decent work.
