An International Court to Ensure Democratic Rights and Human Rights

Abstract

Through practical case studies, the comparative analysis of international constitutions, treaties, conventions, experiences and practices, as well as studies by international institutions, such as the International Court of the Hague, and the Criminal Court, in particular, demonstrates the existing weaknesses and gaps that can be remedied and eliminated with a new international legal institution, that has to be capable of strengthening already existing institutions and achieving the unfulfilled requirements. The main international legal criticisms of institutions and concepts, such as sovereignty and immunity, are raised to question the fragility of resistance to this project.
