Property right: conditions of equality and functioning

Abstract

This article addresses the theme of property rights based on Amartya Sen’s thinking and its correlation with poverty. The objective is to relate the role that property plays in the context of human development. As a proposal, the work intends to analyze to what extent the capacity approach can support the defense of property rights. To do so, initially we examine Sen’s capacity theory. Then, we verify the possible relationship between property, poverty and human development. The methodology of the work was based on theoretical research, with bibliographic survey. In order to justify and argue about the hypotheses raised, the deductive method was used. We intend, in the end, to demonstrate that the right of property represents an important instrumental role for human development, insofar as it constitutes a means for the expansion of freedoms.
