International adoption and the principle of full protection in Brazil and Portugal

Abstract

The objective of the article is to analyze the adequacy of the institute of international adoption from the perspective of international treaties and conventions in the Legal Orders of the Federative Republic of Brazil and Portugal. The method used was deductive and the methodological procedures in the construction of the documentary corpus of analysis considered the theoretical frameworks that define international adoption and the identification of existing convergences and divergences in the legal categories provided for in the legislation of Brazil and Portugal. The research results indicate that the Legal Orders of the Federative Republic of Brazil and the Portuguese Republic, with specific reference to the Institute of International Adoption, have adapted the respective constitutional regulations and infra-constitutional legislation in accordance with the principle of Comprehensive Protection for children and adolescents, taking as a reference the contributions of International Treaties and Conventions, resulting from the internationalist movement in defense of the full protection of children and adolescents.
