The jurisprudence of the Supreme Court on Impeachment and its impact on Municipal Mayors in a discursive perspective

Abstract

This work problem´s develops around the speculation of how the Supreme Court jurisprudence on President’s impeachment impacts the legal framework for the impeachment of the Mayor. The hypothesis is that the same arguments and reasons to decide the impeachment of President apply to mayors. In an approach from the Deliberative Democracy and Discourses, however, such perspectives are highly objectionable. At first it will be addressed the relationship between Deliberative Democracy and accountability of mayors; in second, demarcate, in a speculative manner, the principles of the responsibility crimes; In a third step will analyze the arguments justifying the legal and political nature of the impeachment decision to finally criticize a certain judicial activism that materializes precisely the starvation of the judiciary in taking care of the conditions of the democratic process.
