Impacts of corruption on the fundamental right to a fair trail in compliance to constitutional justice

Abstract

The article discusses the impacts of corruption on the fundamental right to a fair trial, based in the administration of justice, by examining the rights of the parties involved, the efficiency of procedures and their effectiveness, based on the idea of due process, bringing their conceptual and pragmatic regulatory aspects. Furthermore, it demonstrates through the case law the dysfunctionalities that occur in registry courts and their relation with corruption, on the problems related to the efficiency of the justice system, bureaucracy and management of courts and their organs, showing the need to make the mapping of the risks of corruption in the judiciary.
