Notice and Consent vs. Risk Regulation: A systemic approach to digital regulation

Abstract

The fourth technological revolution created an environment of great promises and significant risks, in which socio-structural tensions arouse. Used to convert novelties into profit, the economic system adapted and, based on a business model in which human behavior became the main commodity, it began to expand unbridled. Based on the theoretical framework of the theory of social systems, this article aims to pursue and understand how and from which strategies the legal system can fulfill its function of stabilizing society's normative and cognitive expectations.
