(Cis)genders perspectives in custody hearings

Abstract

Based on fieldwork carried out in Belo Horizonte (Minas Gerais), we sought to comprehend how the flow of Custody Hearings reiterate the penal logic of precariousness in relation to the trans population, throughout two issues: a) the use of the civil name of transgender people in detriment of the “social name” (which is the chosen name); and b) the creation of a standard package of precautionary measures, which includes social assistance but makes their specific demands invisible. To address these two questions, we used the observations written in the field notebook and the semi-structured interviews carried out with agents responsible for the services in Custody Hearings. We found that, there is a framing of trans experiences from cisgenerity, which reinforces the precarious visibility of the trans people and their demands.
