The state of exception in Brazilian Republic

Abstract

This work sought to analyze the institutes and the exceptional practice in Brazilian republican period (1889-2014), through official data and researches of Brazilian Senate, legal documents and literature related to the subject, aiming at verify the ideas and the praxis of the state of exception and, especially, if this state is really contingent or consists in a continuous practice in that historical period. From the research was verified that the state of exception, formalized by the estado de sítio, was already used as political tool of governmentality in Brazil before First World War, and that exceptional practice, expressed by various instruments, extends continuously throughout the republican period, mixing with the “normality” guaranteed by the ordinary law.
