Materialization of affirmative action for black people in federal public contests in Brazil (Law n. 12990/2014)

Abstract

In this article, we refer to the Law n. 12.990/2014, which promotes access for black people to offices and public employment in the Brazilian Federal Administration by stipulating a quota of 1/5 of vacancies for black people. Likely in the private sector, there is a huge difference between the number of white and black public agents. Although the Federal Supreme Court have decided that the quota law for public contests is constitutional, it remains ineffective and, therefore, insufficient as an affirmative action to support the fight against racism in the public sector. Even though this law determines a quota in favor of black people, data of public contests that took place during the validity of Law n. 12.990/90 point to its ineffectiveness. Structural racism maintains the disparities between whites and blacks.
