“Conselho Tutelar”: a new social alternative for the school failure?

This article aims at analyzing the prerogatives of the “Estatuto da Criança e do Adolescente” (Statute for Children and Adolescents) regarding the their rights to education. We investigated the work of a “Conselho Tutelar” (Tutelary Council) in the city of São Paulo with the purpose of verify in which extent the school is included in the set of complaints taken to the counselors. The documents and interviews analized along with the counselors revealed that the relationship between school and the Council is based on the informality, and in most cases the problems could be solved by the school. The cases are individually sent to the Council and so far, there is no collective actions to face the educational problems which result in disrespect to also increased the fundamental human rights.
