De-Sacramentalization without De-Sacralization: The Judicial Regulation of (Homo)Conjugality in Brazil

ABSTRACT

This article analyses the STF decision on same-sex union. The judicial recognition of same-sex relationships as stable union has reopened the discussion about the role of time in the definition of the conditions that authorize two people to declare themselves spouses. This decision brought to the center of public debate the historicity (the changeable feature) of the legal institution of family.
