Property rights of urban land in Portuguese America: the case of the São Paulo town in colonial period

ABSTRACT

The objective of this article is to discuss property rights relating to urban land in the colonial period. For this, we discuss the case of São Paulo, mainly because this city has preserved almost all of their local historical records relating to urban land concessions. We leave therefore the theoretical formulation of property rights, comparing with the debate on rural properties. The idea is to propose a reflection exercise on the urban institute and think about rights in different ways and relating with the social contexts. We will use the Cartas de data de terra and, through quantitative analysis of concessions, seek to develop urban land features as way to better understand the phenomenon of land in the city and its colonial permanencies.
