Criminal proceedings and inquisitorial coordination in prisons for drug trafficking in Rio de Janeiro: Reflections on the incarceration of women

This work aims at analysing institutional mechanisms of the State that operates processes of criminal subjection of women convicted of trafficking and association with drug trafficking as governed by Law 11.343/2006. To this end, we analysed a set of processes in their execution phase within the scope of the Criminal Executions Court in Rio de Janeiro in the period between 2015 and 2019. Data analysis allowed us to contextualize the characteristics of sentencing decisions that cross the dynamics of female incarceration in Brazil, the construction of cases based on the information contained in the processes, as well as the constitution of a field of forces within the State that results in the production of the permanent and expanded punishment of women. The result of this analysis allowed us to observe two dramatic dimensions in relation to the Brazilian Criminal Justice System. On the one hand, criminal proceedings are not mere official digitalized papers that support a hermetic language of law, but a state field that builds lives in such a way as to make them abominable and punishable. On the other hand, the processes constituted an empirical research field that also allowed us to problematize the idea that our justice system would not exactly represent a system due to the lack of articulation between the instances that constitute it. On the contrary, we could observe that there is a system characterized by a specific type of articulation, which we call inquisitorial articulation, which reveals itself exactly at the meeting point of people whose lives are considered tiny our infamous with state power.
